Terms and Conditions

Please read these Terms carefully before accessing any Pilates and the City (referred to as PATC in this document) content, programmes, classes, or events. By using this website or participating in any Pilates and the City offering, you agree to be bound by these Terms.

EFFECTIVE 1 January 2025

Important. Tammy is a qualified Pilates mat instructor, not a medical professional or physiotherapist. All PATC content — including classes, programmes, challenges, events, and social media posts — is intended for general wellness and fitness purposes only for healthy and uninjured individuals, and does not constitute medical advice, diagnosis, or treatment.

Unless expressly stated otherwise, PATC programmes and classes are not designed for use during pregnancy or in the postpartum period. If you are pregnant or postpartum, please seek guidance from a qualified medical professional or a specialist pre- and postnatal instructor before participating in any PATC Offering.

If you have any health concerns, injuries, or pre-existing conditions, please consult your GP or a qualified medical professional before beginning any exercises or workouts offered or shared. By purchasing, booking, or accessing any PATC offering, you do so at your own risk and agree to these Terms in full.

About These Terms

These Terms and Conditions ("Terms") govern your use of the PATC website, all digital programmes, on-demand and live classes, challenges, events, workshops, social media content, and any other offerings made available under the PATC brand (collectively, "PATC Offerings").

These Terms apply whether you access PATC Offerings via this website, a third-party platform (such as Instagram, Substack, or a booking system), or in person at a live class or event.

By accessing or using any PATC Offering — including viewing content, making a purchase, attending a class or event, or following PATC on social media — you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use PATC Offerings.

These Terms are intended to be legally effective under Norwegian law, UK consumer law (including the Consumer Rights Act 2015), and applicable EU consumer protection regulations. Nothing in these Terms affects any statutory rights you may have under the law of your country of residence.

Who We Are

PATC — Pilates and the City is operated by Tammy ("PATC," "we," "us," "our").

Tammy is a qualified Pilates mat instructor. She is not a medical professional, physiotherapist, personal trainer, nutritionist, or other licensed healthcare provider. PATC is an independent brand for general wellness and lifestyle only.

Health, Safety & Personal Responsibility

Your health and safety are your responsibility. PATC Offerings — including all classes, digital programmes, challenges, events, and any guidance shared via social media — are not a substitute for medical advice, physiotherapy, or treatment of any kind.

Before participating in any PATC Offering, you confirm that:

  • You have assessed your own fitness and health and consider yourself fully healthy and uninjured to be able to participate safely.

  • Unless a specific PATC Offering is expressly described as suitable for pregnancy or the postpartum period, PATC programmes and classes are not designed for use during pregnancy or postpartum recovery. If you are pregnant or postpartum, you must seek clearance from a qualified medical professional or a specialist pre- and postnatal instructor before participating.

  • You will inform the instructor before a class or event begins if you have any injury, pregnancy, allergy, sensitivity, illness, or other condition that may affect your participation — whether attending in person or live online.

  • You will work within your own range of movement and comfort at all times. You take full responsibility for moving in a range to your ability.

  • You will stop exercising immediately if you feel pain, dizziness, shortness of breath, nausea, or any form of discomfort, and will seek medical attention if necessary.

  • You will follow all safety instructions given by the instructor during classes and events.

PATC reserves the right to refuse participation if it reasonably believes a class, programme, or event is unsuitable for you, or if your participation may create a risk for you, other participants, the instructor, or the venue.

PATC content is intended for healthy adults who do not have conditions that would be adversely affected by a moderate general fitness programme. Postpartum participants should have received clearance from a healthcare professional before beginning any exercise. The presence of modifications in any programme does not replace professional medical guidance.

Assumption of Risk & Waiver of Claims

Physical exercise involves inherent risks of injury, strain, and physical discomfort. By participating in any PATC Offering, you voluntarily and knowingly assume all such risks, whether known or unknown at the time of participation.

To the fullest extent permitted by applicable law, you agree to release, indemnify, and hold harmless PATC, Tammy, any collaborators, guest instructors, and venue partners from any and all claims, demands, damages, losses, liabilities, costs, or causes of action arising from or related to your participation in any PATC Offering, including personal injury, property damage, or illness, whether arising from negligence or otherwise.

This waiver applies to digital content, on-demand classes, live online sessions, in-person classes, workshops, events, challenges, and any guidance accessed via social media.

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by gross negligence or wilful misconduct.

  • Fraud or fraudulent misrepresentation.

  • Any liability that cannot lawfully be excluded or limited under Norwegian law, UK consumer law, or the law of your country of residence.

Programmes & Digital Content

PATC digital programmes, challenges, and on-demand class libraries ("Digital Offerings") are made available for personal, non-commercial use only. Access is granted to you individually and may not be shared, transferred, gifted, or resold.

On purchase of a Digital Offering, you are granted a limited, non-exclusive, non-transferable licence to access and use the content for personal wellness purposes. This licence does not constitute ownership of the content.

PATC reserves the right to amend, update, replace, or remove any content within a programme or digital library at any time, without prior notice. Such changes do not entitle you to a refund where the overall nature and value of the Offering remains materially as described at the time of purchase.

Results and outcomes. PATC makes no guarantee of specific health, fitness, or body composition results from following any programme or class content. Individual results will vary.

Refunds. Due to the digital nature of the content, PATC programmes are non-refundable once access has been granted, except where required by applicable consumer law. UK customers retain the right to cancel a digital subscription or purchase within 14 days under the Consumer Contracts Regulations 2013, unless they have expressly consented to immediate access and acknowledged the loss of their cancellation right. Norwegian customers retain statutory withdrawal rights under the Norwegian Consumer Withdrawal Act (Angrerettloven) where applicable.

Live Classes & In-Person Events

These Terms apply to all live classes, workshops, pop-up events, retreats, and any other in-person or live online gathering organised or co-organised under the PATC brand ("Events").

Booking and attendance. By booking a place at an Event, you confirm that you have read and agree to these Terms, including the health and risk sections above. Bookings are personal and non-transferable unless explicitly stated.

Cancellations by you. Cancellation and refund terms for individual Events will be stated at the time of booking. Where no specific policy is stated, the following applies: cancellations made more than 48 hours before the Event may be eligible for a credit note; cancellations made within 48 hours are non-refundable. PATC may at its discretion offer a transfer to a future Event.

Cancellations or changes by PATC. In the event that PATC must cancel or materially change an Event, you will be offered either a full refund or transfer to an equivalent future Event. PATC is not responsible for any travel, accommodation, or other costs you may have incurred in connection with attending a cancelled or rescheduled Event.

Venue and conduct. You must comply with all venue rules and any instructions given by the instructor or event staff. PATC reserves the right to ask any participant to leave if their conduct is disruptive, unsafe, or inappropriate. In such cases, no refund will be given.

Photography and filming at Events. PATC may photograph or film Events for use in marketing, social media, and editorial content. By attending an Event, you consent to being included in such imagery. If you do not wish to be photographed or filmed, please notify PATC in advance or inform the instructor at the start of the session.

Social Media Content

PATC publishes fitness, wellness, lifestyle, and Pilates content across social media platforms including Instagram and Substack ("Social Content"). All Social Content is provided for general informational and inspirational purposes only.

Social Content does not constitute professional medical, physiotherapy, nutritional, or fitness advice, and should not be relied upon as such. You are responsible for assessing the suitability of any exercise, tip, or suggestion for your individual circumstances before acting on it.

If you choose to follow or attempt any exercise demonstrated or described in PATC Social Content, you do so entirely at your own risk. These Terms — including the health, safety, and liability sections — apply in full to any participation inspired by or resulting from Social Content.

PATC is not responsible for decisions made, or harm arising, as a result of following Social Content without appropriate professional guidance.

Bookings, Payments & Cancellations

Payments for PATC Digital Offerings and Events are processed via secure third-party payment providers. PATC does not store full payment card details.

All prices are stated inclusive of VAT where applicable. PATC reserves the right to change pricing at any time. Price changes will not affect purchases already completed.

Where subscriptions or recurring payments are offered, these will renew automatically unless cancelled before the renewal date. Cancellation instructions will be provided at the time of purchase and confirmed by email.

In the event of a technical error resulting in an incorrect charge, please contact us at pilatesandthecity.studio@gmail.com and we will investigate promptly.

Age Requirements

PATC Offerings are intended for adults aged 18 and over unless expressly stated otherwise for a specific class, event, or programme.

Children and babies may only attend Events where this is expressly described, such as mother-and-baby sessions. Responsibility for the safety and supervision of any child attending an Event remains with the accompanying parent or guardian at all times.

Intellectual Property

All PATC names, logos, trademarks, brand concepts, class formats, programme structures, exercises and their sequencing, visual materials, photography, video content, written text, website copy, Substack posts, social media content, training materials, and all other content and intellectual property ("PATC IP") belong to PATC or are used by PATC under licence.

You may not copy, reproduce, screen-record, download, distribute, teach, sell, commercially exploit, or create derivative works from any PATC IP without prior written consent from PATC.

You may share links to PATC content on social media for personal, non-commercial purposes. You may not re-post, reupload, or reproduce PATC video or written content in full, or use it to create your own instructional materials, without written permission.

Unauthorised use of PATC IP may constitute copyright infringement and/or trade mark infringement and will be pursued accordingly.

Limitation of Liability

Participation in movement-based exercise involves inherent risk. You participate in all PATC Offerings at your own risk and are responsible for listening to your body and participating safely.

To the maximum extent permitted by applicable law, PATC is not liable for:

  • Indirect, consequential, incidental, special, or punitive damages of any kind.

  • Loss of income, loss of profits, or loss of business opportunity.

  • Travel expenses, accommodation, or other costs incurred in connection with attending or attempting to attend an Event.

  • Any loss or damage arising from your failure to follow safety instructions, modifications, or the guidance of the instructor.

  • Any loss or damage arising from pre-existing conditions, injuries, or health circumstances not disclosed to PATC prior to participation.

  • Technical interruptions to digital platforms, third-party services, or online delivery of content.

Where PATC is found liable for any loss or damage, total liability shall not exceed the amount paid by you for the specific Offering giving rise to the claim.

Nothing in these Terms excludes or limits PATC's liability for death or personal injury caused by negligence, fraud, wilful misconduct, or any liability that cannot be excluded or limited under Norwegian law, UK consumer law, or the mandatory laws of your country of residence.

Privacy & Data

PATC processes personal data in accordance with our Privacy Policy, available on this website. By using PATC Offerings and providing personal information, you consent to the processing of your data as described in that policy.

PATC complies with the General Data Protection Regulation (GDPR) as applicable in Norway and the UK (UK GDPR). Personal data is used only to provide PATC Offerings, communicate with you about bookings or purchases, and — where you have opted in — send marketing communications. You may withdraw consent or request deletion of your data at any time by contacting pilatesandthecity.studio@gmail.com.

Changes to These Terms

PATC may update these Terms from time to time to reflect changes in our Offerings, applicable law, or best practice. The Terms applicable to your booking or purchase are the Terms in effect at the time of that transaction, unless any change is required by law or is clearly beneficial to you, in which case the updated Terms will apply immediately.

Continued use of PATC Offerings following notification of updated Terms constitutes acceptance of the revised Terms. We will always publish the effective date at the top of this page.

Complaints & Governing Law

If you have a complaint or concern, please contact us in the first instance at pilatesandthecity.studio@gmail.com. We will endeavour to respond and resolve any issue promptly and in good faith.

These Terms are governed by Norwegian law. If a dispute cannot be resolved directly, you may have the right as a consumer to submit a complaint to the Norwegian Consumer Authority (Forbrukertilsynet) for mediation. Disputes shall be handled by the Norwegian courts, unless mandatory consumer law gives you the right to bring a claim before the courts of your country of residence.

For customers in the United Kingdom, your statutory rights under the Consumer Rights Act 2015 and other applicable UK consumer protection legislation are not affected by these Terms. UK customers may also refer disputes to an alternative dispute resolution (ADR) body where applicable.

For customers in the European Union, you may access the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
